AMLN and VPHM must be in merger talks, from the looks of this chart!

We would most likely have been tied today, had it not been for whoever shorted the opening VPHM bid. Dru, are you purposely manipulating stock prices to win this game? With your uncanny ability to pick winners, I wouldn't doubt you have the capital to do it.

I do think that your AMLN has better chances though, it won't be venturing into uncharted terratories for a while, so the profit taking shouldn't be too bad. Plus a nice cross up through the 50dma today

and some charts are just begging you to buy the stock!

Nice picks, guys. Possibly the hottest chart of them all is AMLN. The forum only lets you post five charts before you have to have a new post, and it got set off by itself by accident--or divine providence--but it is one hot chart.

Just reading what the chart says.

Here's a few comments on today's action:
EBAY--remains in consolidation mode. This rectangular movement means that one day soon she breaks one way or another. I think down, but what do I know?

EIX-I was gone all day today, but I daytraded EIX with a limit order. I bought the first pullback on the open and set a limit and left. Picked up lunch money.

NGPS--I saw the gap up and the open and knew that meant she was coming down to at least yesterday's close. Set a buy limit order for below yesterday's close and picked up 100 shares to daytrade with tomorrow (while I am gone). By the way, these pullbacks signal that NGPS has a lot of overhead resistance. But it keeps moving higher and the weak holders are shaken out and somebody with lots of cash is rocketing NGPS higher.

I think Jiesen may have gotten into a bit of a bind.
Instead of the ibd 100 number 1 jinx, the new one going around is Cramer pumps. He had nice things to say about AMLN last night, and that is when a few people always talk about fading his picks.
I thought it would have been close to 20 today.
BJ coulda shoulda woulda cept for that icky downgrade on SSNC, maybe it can bounce a bit and ERS can take care of the rest.

That's OK Jiesen. Once it got over 31 (average purchase), I was certain it cleared overhead, but that downgrade changed the complexion a bit. Could have gotten away with holding, but I think it will ultimately retest the 28 range, maybe the 50 DMA at about 27, then I'll pounce again. Like before, though, it won't be there long. It probably needed a break.

It looks like VPHM bounced off the 9dma nicely today so I am not giving up, except my best guess is only a tiny bit higher tomorrow with some consoldation and then Mon. or Tues it will be ready again.
It looks like those KBH options would have been the way to go

It came down to the wire for second place, with a bit more mo, Webs ENTU was looking like it wanted to make the run for the win. BJ's SSNC didn't help, but ERS came through and would have had Jiesen sweating bullets at the end if it was a single pick. I don't think Jiesen would have put in the stop if ERS was a single pick either.
All in all, a very nice week, with some very good picks.

sure, posts may be late again, I took a new job so I will be packing and sorting all week. I am going to have to play golf everyday now and get paid for it. Such a shame.

I thought DSTI would consolidate for 1 or 2 more days before proceeding, this one may be the mo for the week again, but for the contest it is where it ends on Fri. It may just have the pullback right then.

ERS still looks nice, but p/e is now getting up there for that sector. Plus it's BJ's if he still wants it.

IPII would be in the same boat as ERS.

AMLN may start to slow down a bit now, but I am looking for over 21 on this one, thanks Jiesen, I went long and am happy.

GEOI looks like it is holding up well, but some may start to think it is way overvalued and flatline for a bit.

TGA, yes TGA take a look, the biggest problem here is that it is AMEX

I still like JMDT and SNDA, but they will probably be too slow for the contest.

How about Web's ENTU, looking good.

SWKS has some mo, maybe we can get a good pullback to fill the gap on Mon. and then continue the breakout.

I guess how much you like BDE depends on where you think oil prices are going. Even at existing levels, BDE stands to make a hefty profit.

I dunno; looks like a minor shoulder-head-shoulder forming. It isn't going to bounce much higher after it touches the $6.28, before it falls to $5--at least, that's what my chart says.

I did pick up some JVA today, and luckily it was an early pickup. Small float, where as for some that can be scary, but I like to look at it as it will be very easy to increase rev and earnings per share. Along with all of this, we have the coffee hype going on, plus if they play their cards right and get the right hedges on coffee, they should make a bundle. The world does not have an overabundance of supply, and with SBUX going into China and looking for nice growth, coffee prices will be on the rise. I remember SBUX going to England and everyone laughed that they wouldn't sell anything because everyone drank tea, England now consumes more coffee than tea. Will China be the same????

I still like TGA, and for some swings, JMDT SNDA JDO(but extended) watch GEOI and ABLE

Thanks everybody...Dru is a great stockpicker...and VPHM was a nice one. But the best part is that WITS is our largest holding...although I'm getting a bit impatient with it. Over 50% of my wife's IRA is in WITS since 4/04...I added in a cash account 6/04. Avg buy 14.49.

This morn was pretty good for me...with this new job I normally cash out before work...Caught ENER +.34, GEOI +.23 and then bailed when oil looked strange...at least that's what my trading partner told me...And she's smarter than I...so I cashed out. Also bot TLWT...ran out of time...so I sold for +.09sh.

This week, I'm going with a different theme titled, "The Cows are Mad"

In honor of the Mad cow disease scare, I'm going short on two restaurants that specialized in Beef.
The thought of wild, drunken Cattle stampeding through the dining areas of large steak houses in a wild rampage to retaliate against those who consume the flesh of the less fortunate, farm raised cows fascinates me. A cow with dementia can be a scary thing. Would you want an insane 700 pound bull chasing after you? I don't know of many people that could survive such an act of violence, with the exception of the mighty Mr Market of course, who would merely flex his 19" biceps causing the bull to turn around and run like a scared little field mouse.

That, of course is just an example of my Vulcan imagination working at warp speed. Why do I even refer to myself as a Vulcan? I haven't watched an episode of Star Trek in years! I do enjoy William Shatner's Priceline commercials though. I especially like the one where Leonard Nemoy steps in to take Shatner's job. Although, I get lots of entertainment from the Priceline commercials,they have never influenced me to actually use Price Line. I always book my flights through Travelocity or Orbitz. I once tried to open the door on a flight over the Pacific ocean, but was restrained by the flight attendents, who were actually Chipmunks in disguise. They were trying to explain to me how they made cheese while they were on Mars when I.... Hang on....I'm rambling on like a mad man...ain't I? I guess I forgot to take my medicine...sorry.

Back to reality.


Like I said earlier, I'm going short on the following two picks who should experience a further drops in share price as the Mad Cow scare progresses.

1. OSI - Outback steakhouse. Aussies are a mad bunch to start with. They should really flip out when their share price drops this week.

2. LNY - I know nothing about this particular restaurant, other than the fact that MSN was recntly pumping it. That should be enough to make it go off the deep end like a cow on Meth.

This is hard to read because this forum doesn't handle multiple spaces, but here is what the numbers mean:

First column is the stock symbol.
Second is the week's opening price.
Third is yesterday's close.
Fourth is today's close.
Fifth is overall percentage gain for the stock.
Sixth is today's percentage gain.
Seveth is total balance in position.

In the last row, the total week gain, total day gain, then total existing balance are tabulated.

Ski, if you or anyone else detects a mistake, please let me know.

What figure do we start with and how do you divide it up? If there were 3 stocks would it be $3300 invested per stock. I had Ray 1st, up 7%, and me 2nd, up 5.5%, with Doug up 4% and DMK up 3%. No big deal one way or another. Just curious how much we started with and how you divide it up. I guess I'm saying that there is a mistake in my portfolio.

Just as I suspected, Ski. I accidentally copied the short formula (which is the inverse of the long formula) into your portfolio. I fixed it and will be reflected in your results today.

The percentages are in fact correct. The mistake was only made in the balance column.

I use the stock prices to compute all percentage and balance info. Maybe I'll change the balance calculation so that it keys off the percent, so that it will all check out internally.

Huge day for me with the 3 longs that I own. I put those 2 shorts in because I own a few Sept. 100 puts on TOL and irrational behavior on GOOG. NGPS got a little contract and went off the scale. Still holding all three of the longs and the puts on TOL.
Nice day Dru. I've been watching that stock for the last couple of weeks and knew it was going to go off an today I just stood by and watched it go without doing a thing. I was mesmerized by NGPS and CMTL. Almost made the play when it was up .50.

So much stuff running through my head all day everyday. Running a construction company and a real estate business. All I really want to do is watch and trade the markets. Trying to do all three is exasperating at times an I do lose track of the calendar.
Having a decent couple of weeks. CMTL is up around 2 points and NGPS is close to 4 points. HTRN is up almost a 1 point. The TOL Sept 100 puts are up just about 1 point as TOL dropped pretty good today. GOOG, which I don't own but have as a short position in the contest, corrected today and gave almost all of yesterdays 4.5 point gain back today. Haven't placed any stops on any of these positions yet. In the morning I'm going to put a stop up close on CMTL and NGPS. Nothing on HTRN.
And you're right I am a little excited about NGPS. I think there is some gas left in the tank and my problem is to stay in the position to grab anymore gains but protect the current gains with a stop at some point which will protect the gains yet not get stopped out to soon. I'm looking at the 28.75 area for a stop. Just alittle below todays low of 28.86. $34 for CMTL. I think we could see TOL drop to somewhere around $96/97 before it starts to look cheap again. So I'm holding tight with those puts to see which way the wind is going to blow with TOL.

In the 3rd grade I had a teacher slapp me across the face (HARD) because she thought I was either stupid or a smart a$$. NOTE: 34 years ago (in the south) a teacher could discipline her students anyway she saw fit!

Flash back .... 1971, 1st day of school .... small town N.C. .... HOT! .... NO air conditioning. New excercise in "changing classes" .... We marched down the long narrow hallway our sneakers squeeking on the polished floor .... A line of (25 give or take) 8-yr-old-snot-nosed kids headed for this (mystery) teachers classroom .... Right behind the "homeroom teacher", I led the line .... As we entered the room, our new teacher "Mrs Creech", in a loud, stern voice said "STUDENTS! you will see your names posted on your assigned desks" .... I quickly found my desk, as my last name begins with "B" and it was near the front of the room. I sat down with my chin resting on both hands and gave Mrs Creech my rapt attention .... Some students (evidently) had found books in the seat of their old wooden desks and wondered what to do with them. She saw them hesitate as they encountered the books in their seats .... She barked " BOYS AND GIRLS IF THERE ARE BOOKS IN YOUR DESK .... SIMPLY TAKE THEM OUT AND SLIDE THEM UNDER YOUR DESK"! .... Already seated, I immediatly bent over and looked "In my desk" for books .... and low and behold .... I found books! So .... accurately following her instructions, I promptly removed the books from their resting place and "slid" them "under my desk" .... or .... onto the floor. Yes, onto the FLOOR! .... DUH!!! .... That's when Mrs Creech (with no explaination what-so-ever) promptly backhanded me!

I guess my problem has always been jumping into a project "with both feet" before FULLY comprehending the instructuions.

SO .... Mr Drutzen ~aka~ Mrs Creech .... You see, I misunderstood BJ's rules. I thought we had $10k to invest in EACH stock (2-10 stocks). If that were indeed the case (which it's NOT) then it's entirely possible to have a specific weekly percentage (%) gain and a different (lesser or greater) dollar ($) gain (than) another participant. SHEESH! .... Now I need therapy!

If everyone was able to throw in a different dollar amount, then the people who cannot afford as much (10000) as the other guy (100000) would complain. That would lead to political strife and class division within this board.

That guy that picked IPIX is a Vulcan. See the pointed ears. They are known for throwing a dart at the stock pages in the IBD Daily and have a phenomenal percentage rate of winners in doing so. I did own the puts on TOL so I thought I would put it in my picks. Don't know what possessed me with GOOG. Thought it was overbought and ready for a drop. I'm probably a week early an it will gap way down this week. Very happy with the other three. NGPS up almost 6 points right now an about 2 with CMTL. Still waiting for HTRN to go off. Been holding it's own at around 13.50 which is up 1 point from my latest entry. Only thing with NGPS and CMTL is that I only took a half position, 500 shares, with each one.
I made one move today and bought a half position in VPHM today at 8.50. Caught an interesting article this morning on Briefing.com newswire about VPHM. It was gapping up at the time an this convinced me to make the trade. Been watching it for a few weeks now since Drutzen first brought it to the contest. Should have been in under 7.
Congratulations Dru on another smashing, pulverize their brains and squash their egos, resounding win again this week. How many is that now 19 or so? Our only consolation is that we bought your pick.
It would be a good idea for everyone here to buy this stock while it's still in this range and somewhat cheap.

With VPHM I started a good sized position under 4, and then added to it at 4.8, avg for all is around 140%. I am pretty happy with it. I may have to take some off just because, but then again, if it ain't broke......Since I am not around much anymore, this would be a good candidate for wide trailing stop for me I guess, at least on half of it.

I will stick with it for next week, but I still like JVA too. It did well, but I am trying to figure out the gap up and then drift down all day on Fri. Maybe it is good for it, so it won't have much of a gap anymore.

I don't own any of 'em...it is very difficult for a day trader to come up w/ one week pix...heck...it's hard enough to come up with stocks that will go up for an hour. But in my weekend perusals...I come up with some that look pretty good...sometimes.

BTW...PTC has been # 1 in the IIC 100 the past coupla months...and before that it was pretty high on the list...maybe I'll just compare the IIC 100 to the IBD 100 results...hmm...seems like I'm beating them by over 50%...let 'em prove me wrong...LOL

Thanks all, but I have to give IIC some accolades with the PTC pick, if he didn't like diversification so much I would have had my behind kicked.
I am not really fond of the bigger volume down day 2 days ago, but a little profit taking isn't bad. Plus they will have to buy it back when it goes back over 10 again next week.
If it ain't broke, don't fix it. I'll stick with it for next week.
One you may want to look at is TIE, sold off pretty hard, but held 50dma, just a lot of profit taking. I think it should bounce back a bit next week.
I am giving JVA another day to get back over the 9dma, but if you notice, the up days volume is crap, so I may just dump and go.
Overall the week was pretty crappy for me, got killed Thur when the dow was up nicely. go figure.
Oh well, another week next week, long VPHM, have not sold any yet. So I am happy

I noticed that too .... Most of my screens are tracking micro, small and mid caps .... My large cap screens were as green as grass in May.

Seems to me that money is flowing out of smaller caps and into larger caps. Might warrant a strategy change for small cap investors .... OR .... Small cap investors could see some good bargains shortly, if that's indeed happening.

But before I really started digging into it this morn...I had the same thought as you...I would attribute that to a rotation...stocks that I don't normally watch were up; e.g. Autos, Home Improvement, Industial Suppliers, Airlines while Healthcare, Medical Supplies and Oil stocks were generally down.

Dru is kicking the shit out of all of us anyway. My only consolation is that I bought a half position of VPHM at 8.70 and look where it's at now. I'm blessed. Thanks all, but I have to give IIC some accolades with the PTC pick, if he didn't like diversification so much I would have had my behind kicked.
I am not really fond of the bigger volume down day 2 days ago, but a little profit taking isn't bad. Plus they will have to buy it back when it goes back over 10 again next week.
If it ain't broke, don't fix it. I'll stick with it for next week.
One you may want to look at is TIE, sold off pretty hard, but held 50dma, just a lot of profit taking. I think it should bounce back a bit next week.
I am giving JVA another day to get back over the 9dma, but if you notice, the up days volume is crap, so I may just dump and go.
Overall the week was pretty crappy for me, got killed Thur when the dow was up nicely. go figure.
Oh well, another week next week, long VPHM, have not sold any yet. So I am happy


I started to worry yesterday about TIE, but she came back pretty nicely today, up over 11 for the day. As for JVA, i am still holding. But I did have a nice chunk of CAFE, and kept some for longer.
About CAFE, they have warrants expiring on July 21 at 11 AM, 12 mil. more shares added. Current shares outstanding, 4.9 mil, with 3.6 mil float. I don't know when the shares will be delivered, or if the market makers can trade them right away, but I would expect a sizable dip coming up for all of these new profit takers, plus the outstanding shares will more than triple. Could be the time to get in. They have a contract for only 10 wal mart stores now, but the first test wal mart gave them a 19% savings in energy for their lighting. After the next 10, sky's the limit???????? Plus their are many other stores other than wal mart. I need to find out if their system is patented or not though.

I really like your short pick with ACEL: All it needs to do is break that lower green line and she should drop fast. That red channel action is very bearish, and the whisper that the triple bottom may fail. I didn't include vol by price on there, but it's heavy around 4.20, so if your picks works, that volume is what can fuel any selloff after a triple bottom failure.
On the bullish side, should price break up through the triangle price should search for that blue upper channel line. Above 2.80 is where any short stops wouild be.

Can you elaborate on your NGPS choice for a short, webs? If you'd like that is... thx

It's had 4 up days in a row. My Vulcan logic tells me that it's time for a few down days. Any further explaination would require a direct Vulcan to human mind data transfer, which can be extremely painful and possibly lethal.

Hey BJ or anyone else .... In preparing to set up this contest I have back tested some of the results from last week and I'm finding some inconsistancies. Could someone double check a few tickers and see what the % gain/loss last week was. A few I am questioning are MSTR, HTRN, FORD ....

On MSTR in particular my data shows a very different week opening price. I show it opened on 7-18-05 @ 66.84 and closed @ 67.80 on 7-22-05 resulting in a weekly gain of $0.96 or 1.44%.

On the others listed above the math just ain't working for me.

I thought I would set it up this way:

Stock Wk-open today's-close $gain/loss %gain/loss Balance

The $gain/loss (per share) and the %gain/loss would be interim figures and up to date as tallied, I see no need to list the previous day's data. Am I missing something?

Upon further review I think I know the problem. It is that there are some differences in the week opening figure that BJ used and the ones on data base shows. Example: I show FORD opening @ 18.51 not 18.50 .... I show MSTR opening @ 66.84 and not 67.00 (big difference) .... After checking HTRN again (and not rounding any decimals up or down) I came up (to the penny) with BJ's figures. I back tested several more and also came up with the exact figures as BJ.

OK fellas.... I'm confident that I can accurately keep score even though I'll configure the score card a little differently than BJ.

BJ where do you get your wk-open stock price from? I'll probably just use yahoo finance.

I disagree. Where there's a will, there's a way! The big boys short these disasters all the way down to 0 all the time. And even when all the shares have been borrowed, naked shorting continues to drive down the price. The fact that we need Reg SHO (even though it doesn't work- in fact it practically legitamizes naked shorting) is proof that it's indeed going on. Anway, there's no way for the contest holder to verify availability of shares, so why bother trying to determine which could/couldn't be shorted in the "real world". Maybe a lower $ limit is worthwhile, just to keep me from shorting GBMS again, but $5 is a bit high. Lots of good short candidates can be found in the $1-5 range. ABRX is a great example.

Short selling is a great way to build your earnings, Just look at some of the short picks here that are performing GEPT 15.02% * DSTI 9.13% * ACEL 8.02%. Ray didn't want to play short and just look at his pick from yesterday, sure is beating his long pick.lol .... About limiting what stocks we can short .... I do tend to agree with Doug's opinion, I doubt you or I could short ABRX this morning if we wanted to. If I run the contest next week I'll look into changes.

Please post your ideas for changes and tell me if you spot any more errors in my results.

Poorman is not the only one they are going after. I won't mention names because I promised not to. The only reason I would talk about Bruce is because he chose to make his plight public...as did the Istarquest.com guy who I don't personally know.

But what perplexes me is why they go after people that mention them and they don't go after people who copy their data and sell it? As you know, I am somewhat of a busybody...I know many sites that sell their info. And I will admit...that does not seem legal in many cases. But, it is beyond me why they go after a guy like Bruce who they featured in their "Smart Investor" Section a few years ago. Was it OK then...but not OK now???...Who knows???

Now let's take the Istarquest.com guy...He published his analysis of the IBD 100 each week. I'm not particularly interested in the list so I didn't pay too much attention...But, lets compare that to someone who analyzes the DJIA...Like the people who wrote "Dogs of the Dow"...Did they have to get permission?...I would rather doubt it.

Anyway, the lists I post every day/week cannot be found using IBD...unless you want to look at their 7,000+ charts...and even then...you would not be able to find the technical lists I publish...For example, I will give $100 to the first person who can run a scan using only IBD info to come up with my daily MoMo List.

Roger D. Lockhart sold 392,330 shares of Host America for $13.85 a share, in trades worth almost $5.3 million, according to the filing. That reduced his holdings in the company to 24,500 shares.

Host America shares rose after the company disclosed on July 12 that it was surveying 10 locations operated by Wal-Mart Stores Inc. But he starts at the first trade...not the last trade price before it was halted...It doesn't matter anyway...it won't be trading any time soon...if ever.

Lye you're the winner this week. A two timer already. I'm sure you've done the calcs and already know that an I hope you had at least one or two of them for real. So it really doesn't matter now what the outcome of Dru's picks are. So no penalty or punishment due in this particular instance. I was thinking though that it might have been fun to stake him out from each arm and leg, in the heat of the day, and open his abdomen, baste his body with maple syrup and then place some red ants on him. That would teach him to never do that again. But then he did bring VPHM to our attention and he should be given some consideration for that. OK no maple syrup.

Since we are here to make money.
I traded shares on a Monday during the run, and sold all but a few. After selling, I had a profit even if I counted the remaining shares at 0. Which may well be what I will get.

Tankers rally?! I don't know about all of them, but some should do nicely. Some charts look great, others not so great. Here are a few tankers I like:

TUG; entry on a pullback to time the corrective wave completion, preferably to a channel long day.
RAMS; young one, but daily channel long recently, bull flag formation, potential 5th impulse coming.
TEU; big inverted SHS on the weekly targeting 25.00ish, weekly channel turn up, great vol by price support, and daily volume, and broken price resistance.
NAT; good weekly count with at least one big impulse left, weekly channel long just occurred. Caveat is a potential SHS, so while neckline holds I'd be bullish.

Actually...there is a cooling off period of either 25 or 30 days on IPO's...but I believe that has to do w/ announcements. I don't think it applies to shorts...HOWEVER, to short there must be a valid stock certificate on the shares you borrow...Extremely tough to locate on IPO's. If you want to short an IPO I suggest a Large Full Service Broker...You will pay dearly in commissions though.

Think about it...When was the last time you bought a stock and received the Certificate?...Yes, you can buy them via online brokers...but how many of us do? The last time I actually got one was in the '70's...Doug(IIC)

PS: I happen to have many old stock certificates dating back to the 1880's...Collecting old certs is called Scripophily...Some have very nice vignettes. Many of the very old ones are railroad and mining cos.

yes, GFCI must finally be ready to release that update on the Jet Motor deliveries. These 50 units are supposed to generate $2M/month in mostly profit!
With 25-30M shares outstanding that means nearly $1/year EPS is possible... Not necessarily likely, but possible.

yes, GFCI must finally be ready to release that update on the Jet Motor deliveries. These 50 units are supposed to generate $2M/month in mostly profit!
With 25-30M shares outstanding that means nearly $1/year EPS is possible... Not necessarily likely, but possible.

Coil Tubing Technology Inc., a wholly owned subsidiary of Grifco International Inc., produces the "Jet Motor," a proprietary product for the oilfield drilling and production workover industry. The oilwell workover industry has long desired a downhole drilling motor that can operate on coiled tubing workover units with fluid or nitrogen wells up to 600 degrees Fahrenheit to effectively clean paraffins, calcium carbonates and barium in tubular production strings.

The design concept behind the Jet Motor was to provide the industry with a rotationally driven tool, independent of the workstring, without elastomers and able to produce sufficient horsepower. The requirements were that the tool needed to operate on fluid or nitrogen and the tool needed to supply sufficient jet velocity and impact force to the nozzle. Overstock, The Den Of Thieves, and the Master Mind
The names involved are incredible, a veritable who’s who of the hedge fund world and Wall Street:

David Rocker. Leon Black. Tom Barton. Marc Cohodes. David Einhorn. Jim Cramer. Kroll. Barron's. The WSJ.

And at the bottom of it all, the Master Mind. Some on the Yahoo boards have a speculation, which seems credible to me. Check out this post. If true, this is the guy who was a poster boy for corporate raiding and stock manipulation, who's spent much energy and money to present a benign and innocent façade since he was released from Federal prison.

The name wasn’t mentioned, but the initials seem like a good clue. Master Mind. Famous 80’s securities criminal, back in business, unbeknownst to the SEC. MM.

It all starts to make sense. In today’s Overstock.com conference call, Dr. Patrick Byrne laid out a master plan of manipulation that is staggering in the comprehensive way that it covers all the bases – media, regulatory, hedge fund, financial – and which is the single most complete coordinated conspiracy I have ever heard of. It actually makes a lot of sense once you think through the connections, and read some history about the likely MM, rather than the puff piece propaganda generated that frames him as a victim of the bad old anti-Wall Street government. The guy I’m thinking of was involved in a stock manipulation scheme the likes of which had never been seen before, and he got put away for it. While he was in jail, he was allegedly teaching an MBA level course to other inmates on how to game the system (this from an insider and former regulator who was involved in shutting it down). Once out, he spent considerable time and money sculpting a front as a philanthropic hero, misunderstood, brilliant and persecuted. I’m guessing that this is who Byrne was thinking of.

Many don't remember, but Giulliani took him down. The same Giulliani that is a partner at one of Dr. Byrne's attorney firms. When you look at what Giulliani put him away for, it was being a master stock manipulator. A guy who stole money from shareholders by systematically breaking the law. Not too glamorous or noble. If it is him, the SEC and the DOJ needs to get on this now, contact Byrne and the legal team and see what evidence they have.

Here we have again, laid out in living color, a master-planned stock manipulation scheme that involves the theft of billions and billions from American shareholders, according to Dr. Byrne. Old habits die hard, and when you are used to being the smartest guy in the room, the guy for whom none of the rules apply, it has to be tough. It also shows that if it is him, he learned nothing from his stay in Club Fed, other than how to cover his tracks better.

The Call Blow by Blow

What can be said that Dr. Byrne didn’t say in his conference call? Let’s recap.

First and foremost, about 100% of the total outstanding shares of OSTK are held by insiders, and strong institutions that aren’t trading. Which inevitably points to massive counterfeiting of the company’s shares, as it trades between 500K to 1.5 million shares on any given day – and none of the actual owners are trading. So that begs the question how are an estimated 10 million or so shares (counting FTDs) going to cover when only 100K or so shares are actually in the float? And who allowed this wholesale counterfeiting to get this far? This is not some OTCBB stock selling shares out the back door – it is a billion dollar market cap company on the NASDAQ, that regulators and the exchange are supposed to be protecting – in other words, this isn’t supposed to happen. So how did it?

Dr. Byrne introduces the cognitive disconnect with one of his first slides, wherein he shows the huge disparity between the number of transactions the exchanges report, and what the brokers report - often more than a 100% disconnect, for long stretches. He postulates that this is the infamous "ex-clearing" gimmick at work, wherein larger brokers keep a separate set of books to document trades with no delivery, and swap those IOU's back and forth between brokerages, removing them from the prying eyes of the regulators, and enabling easy churning between related accounts. That seems plausible given the fact that for 99.99999% of all companies, the two metrics are in lockstep. OSTK is different. Lucky them. Coincidence? Not likely.

But that is just the preamble. The meat is an expose of a stock manipulation scheme involving some of the biggest names on Wall Street. According to Dr. Byrne, the assault on a number of companies by the same network of hedge funds, using the same techniques, is part of a coordinated engine of corporate destruction being perpetrated using all of the tactics I described in the Q4 OSTK CC, and then some. Its tentacles intrude into the media via an intricate network of interpenetrated relationships, into politics, into corporate espionage, into the DOJ and the SEC by powerful and rich men accustomed to swaying the rules in their favor. The driving force is a network of hedge funds structured and beneficially owned by a “Billionaire financier” who was unnamed (but Byrne said he could name him, or rather declared “I Can”), and directed by a Master Mind who was a famous uber-market criminal from the 80’s.

It all fits. If the message board poster's guess is correct, who else would have the intelligence and contacts to create this sort of web of deceit and illegal activity, than the guy that invented the modern variant of the game?

So now the question is what is going to be done about it? The information is out there. Their bankers are no doubt now freaking out and trying to figure out how to contain this, how to run disinformation, and distance themselves. The inevitable huge class action lawsuits will come, as the pockets rarely get this deep. Discovery will no doubt implicate more of a who’s who of the nation’s wealthy, where self-made is synonymous with immune from prosecution – until now.

I had made a number of predictions in the previous Sanity Checks. One very specific one relates to "financial journalists" who have been co-opted by the bad guys, and who appear to me to be nothing more than mouthpieces and apologists for the perpetrators. And right on schedule, bam, first Carol Remond publishes a slam with a false and deliberately misleading and alarmist headline (it read "OVERSTOCK subject of SEC Probe", referring to the rumored informal investigation initiated by these hedge funds, that Dr. Byrne said he'd heard about from February, that fizzled into nothing) and then the Lapdog trotted out a typically lame commentary, that ignored all of the facts laid out by Byrne, and focused on being an apologist for the hedges. We were also treated to CNBC referring to the perpetrators as "respected hedge funds" (there's an oxymoron) by talking heads that barely could conjugate or read their lines.

The inter-connectedness of the players, most of whom are within a 1 mile strip of Manhattan, is pretty damaging, and the scenario is plausible to my ear. This also explains why the financial press seems so disinterested in reporting on the obvious manipulation that has been noted by blogs all over the web. It explains why so many of the supposedly unbiased reporters invariably have an agenda. It explains why so many shareholders have been completely and totally screwed by a system that has apparently been robbing them blind, in a fraud as blatant and complete as Enron, Worldcom and Tyco combined. And it explains why Spitzer is so disinterested in exploring this. After all, he’s friends with one of the participants, and undoubtedly needs campaign money to run for governor – and these are billionaires we are talking.

So now we have all the puzzle pieces, and the SEC and the Department of Justice can’t just pretend that conference call didn’t happen, and the brokers on the hook for the 10 million bogus shares of Overstock can’t just keep selling counterfeits and pretending they are real. Or maybe they can, judging by today's trading.

Anyone holding OSTK shares should get paper certificates, now. That will be the only protection from the coming meltdown, as millions of shares that don’t exist have to be covered out of around 100K real shares.

Folks, email and fax your federal and state regulators demanding subpoenas be issued immediately against the parties named in this call. Call your brokers and demand your shares be issued in paper form, today, no excuses.

And if you are holding any of the other companies these guys have been robbing, NFI, NAVR, PPD, KKD, NFLX, ALD, TASR, HANSEN, etc. do the same.

Just to end on a fun, upbeat note, here's a multi-part bonus question for the gang: What founder of what private investigation/security firm lives next door to what secretive hedge fund mogul, whose wife worked for what financial periodical?

It really is a small world.

Hopefully law enforcement will now get involved and put a stop to this, and bring the perpetrators to justice. If not, it will all come out in discovery.

Manipulation can work both ways though; in the end, trading is speculation and risky, which is why one should diversify and use sensible risk and money management. That way, if one stock blows up in yer face you aren't wiped out. I'm sure all the undiversified ENRON bag-holders would be the first to agree. Oh how experience can be the great teacher. Only through pain does it really sink in that we must protect ourselves. Many a kid thought they could fly, just like superman, only to find out how much it hurt when they tried.

Why does THIS situation make you NOT like short selling? There are crooks long, short .... tall, fat, thin, male, female, etc... Crooks are crooks just like cockroaches are cockroaches, might slow them down but ya can't stop them.

There are over 8,000 stocks out there (at least there's 8k+ in my data base, many bb stocks not tracked) Of those a large % are overpriced JUNK ....

Why not include research on poor quality (overvalued) stocks that might fall in price in your dd schedule? Looking at the down side potential of certain stocks will keep you very aware of market tops (you'll be looking for downturns) and thus make you a more balanced (diversified) investor. If your bias is always long, you'll miss a ton of opportunity to profit from ALL the market has to offer.

That's fine Lye...and I agree...the best know how to long and short...But my philosphy is There's "ALWAYS" something moving (up)...Heck, even on Black Monday back in October '87 there were 3 stocks that made new highs...Of course, I didn't own any of them...I was in cash since the end of 8/87...but that's my philosphy...Look for what is in favor at the moment.

I was talking to my trading partner this evening...we both agree that good stocks are too volatile...We both would prefer to Swing(trade)...But even though my usual trade is shorter(time frame) than her's...we are in/out quick...take it when you can get it...Admirable that you can make $$$ on a "Long Term" trade...Long Term = 2 or more days lately :(
